HIPAA Authorization
Interactly AI provides services, such as scheduling appointments with your chosen healthcare provider(s) ("Your Healthcare Provider") and sending you appointment notifications ("Interactly AI Services"). To deliver these services, Interactly AI may collect, use, share, and exchange your health-related information with Your Healthcare Providers.
Protected Health Information (PHI) and Safeguards
Under the Health Insurance Portability and Accountability Act ("HIPAA"), some health information received by Interactly AI from or on behalf of Your Healthcare Providers may be considered "protected health information" or "PHI."
HIPAA mandates privacy and security safeguards for your PHI by restricting how "Covered Entities" (like most healthcare providers and health plans) and their "Business Associates" (like Interactly AI, which assists Covered Entities) can use and disclose this information. In certain situations defined by HIPAA, a Covered Entity (Your Healthcare Provider) must obtain your signed Authorization before disclosing your PHI to a third party.
Non-Protected Health Information (Non-PHI)
Information Interactly AI receives from you that is not covered by HIPAA is handled as described in the Interactly AI Privacy Policy ("Non-PHI").
Your PHI Authorization
This Interactly AI Authorization ("Authorization") serves as your written permission for Interactly AI to use and disclose your PHI. If Interactly AI operates as a Business Associate for Your Healthcare Providers, this Authorization is required for Interactly AI to handle your PHI.
You specifically agree that Interactly AI can use your PHI to:
- Enable and personalize your use of the Interactly AI Services.
- Send you alerts or other Interactly AI Services regarding future appointments.
- Conduct analysis for the business purposes of both Your Healthcare Provider and Interactly AI.
- To schedule appointments with health care providers on your behalf
- To conduct insurance benefits checks on your behalf
- Allow our business partners to perform essential services (such as hosting, fulfillment, or data storage and security) related to the operation or delivery of our services, even if Interactly AI is no longer working on behalf of Your Healthcare Providers.
- To collect, aggregate, and organize your information to improve accessibility for your providers.
Redisclosure Risk
When Interactly AI discloses your PHI, we require the recipient to agree to use and disclose your PHI only to fulfill its specific business obligations to Interactly AI or for the permitted purpose of the disclosure (as outlined above). However, Interactly AI cannot guarantee that any person or entity to whom your PHI is disclosed will not re-disclose it in ways you or we did not intend or permit.
Authorization Duration and Revocation
Your Authorization remains active until you submit a written notice of revocation to Interactly AI.
To revoke this Authorization, you must notify Interactly AI by submitting a revocation through your account settings page.
- Your decision not to sign or to revoke this Authorization will not prevent you from using certain Interactly AI Services.
- Revocation is effective after you submit it to Interactly AI, but it does not undo any actions Interactly AI took in reliance on the Authorization before it was revoked.
- Once Interactly AI receives your revocation, we can only use and disclose your PHI as allowed under our agreements with Your Healthcare Provider(s).
- Your revocation does not affect Interactly AI’s use of your Non-PHI.
Interactly AI will inform Your Healthcare Provider(s), both current and past, of your agreement to or revocation of this Authorization.
